The Essentials: NIF & Banking
The NIF (Fiscal Number)
You cannot buy property without a Número de Identificação Fiscal (NIF).
- How to get it
- Residents can apply at a local tax office ("Finanças"). Non-residents often need a fiscal representative or can apply via specific online channels, depending on their citizenship.
- Documents
- Passport / ID and proof of address (in English) from your home country.
Opening a Bank Account
You'll need a Portuguese account for transaction payments and utility bills.

The ultimate proof of ownership, confirming the seller's legal right to transfer the property to you.

Land Registry Certificate (Certidão de Teor)
The property's full history, including any active mortgages, liens or legal encumbrances that must be cleared before the sale.

Tax Document (Caderneta Predial)
Issued by the tax authorities, outlines the property's fiscal value and confirms that all municipal taxes are up to date.

Habitation License (Alvará de Utilização)
Certifies the property was built according to municipal regulations and is legally approved for residential use.

Technical File (Ficha Técnica de Habitação)
For properties built after 2004, detailed technical specifications of the construction and materials used.

A mandatory rating (from A+ to F) covering the home's energy efficiency and thermal performance.

Paid on profit when you sell.
Buying taxes
IMT, Municipal Property Transfer Tax
The primary tax paid by the buyer. Calculated on a progressive scale, typically ranging from 0% to ~8%. The exact rate depends on the purchase price, the property's location and whether it will serve as your primary residence or a secondary holiday home.
Stamp Duty (Imposto do Selo)
A standard tax applied to all real estate transactions, fixed at 0.8% of the property's value as stated in the deed.
IMI, Annual Municipal Property Tax
Once you become a homeowner, you'll be responsible for this annual tax. Typically 0.3% to 0.45% of the property's tax asset value (Valor Patrimonial Tributário).
Selling taxes (Capital Gains)
If you decide to sell your property in the future, any profit made (capital gains) is subject to IRS (Income Tax). While tax laws have historically treated residents and non-residents differently, recent legislative changes are moving toward unifying these rates. Certain exemptions exist, for example, if you sell your primary residence and reinvest the proceeds into another permanent home within the EU/EEA, you may be exempt from a portion of this tax.

The Buying Process: A Step-by-Step Journey
Purchasing a property in Portugal is a structured legal process designed to protect both the buyer and the seller. Here is a clear breakdown of the path we'll take together.

The Promissory Contract (CPCV)
Once your offer has been accepted, we move to the Contrato Promessa Compra e Venda (CPCV). This is a legally binding contract that secures the deal before the final deed is signed.
- The agreement: outlines the final price, the payment schedule and the deadline for completion.
- The down payment: upon signing the CPCV, the buyer typically pays a deposit of 10% to 20% of the purchase price.
- Legal security: if you, as the buyer, decide to withdraw, you forfeit your deposit. If the seller backs out, they are legally required to refund you double the deposit.

The Final Deed (Escritura)
This is the "closing" stage where ownership is officially transferred from the seller to you.
- The notary: the ceremony takes place before a Public Notary, who acts as an impartial witness.
- Final verification: the Notary ensures all legal documents are in order, all taxes (IMT and Stamp Duty) have been paid and no last-minute encumbrances exist.
- The transfer: you pay the remaining balance, the deed is signed and, most importantly, you receive the keys to your new home.

Official Registration
The process doesn't end at the Notary's office. Immediately after the deed is signed, the property must be officially registered in your name at the Land Registry (Conservatória). This step is vital, it ensures your ownership is recognized by the state. The actual certificate update can take anywhere from a few weeks to a few months, but your ownership is secured from the moment the registration is filed.
